Thierry Ongenae is a fully three-lingual Belgian lawyer, member of the Brussels Bar since 1989. Prior to co-founding the firm in 2005, he was senior counsel in the corporate and litigation department and in the banking and financial law department of the Benelux law firm NautaDutilh since the start of its Brussels office in 1994.
Thierry has in-depth expertise in corporate and commercial transactions and litigation, including arbitration, and has focused his litigation practice since many years on banking, insurance and reinsurance matters. He currently represents major banks in litigation matters related to the bank’s liability for disregarding MiFID rules of conduct in mis-selling of (complex) financial instruments. In this context he was able in recent years to obtain the most relevant case law in Belgium regarding mis-selling of derivative products, such as Bermudan callable swaps.
Thierry is also particularly experienced in advising financial institutions and insurance organizations in implementing and complying with MiFID, IDD and ESG requirements, as well as in assisting them in subject matter issues with regulatory authorities. He was in charge of the legal management of the implementation of MiFID I within FORTIS GROUP (18 jurisdictions), of MiFID II within BNP Paribas Fortis (retail and private banking), and recently advised on and managed the implementation of IDD remediations and ESG requirements for a major insurance distributor.
Apart from these practices, Thierry is since may years regular counsel to several diplomatic missions in Belgium. Thierry was born in Ghent on April 7, 1965. He is graduated from the universities of Antwerp and Leuven (KU Leuven, 1988), and is married and father to four children.
